Charles Edward Coleman appeals from an order of the Circuit Court of St. Francois County, Missouri, denying his companion motions to vacate judgments and sentences under Rule 27.26. We affirm the order of the trial court. Appellant was arrested on April 13, 1973, subsequent to the robbery of a gas station. During the course of the robbery a station attendant and a customer were killed. The charges brought against appellant included two counts of first degree murder, one count of first degree robbery, one count of kidnapping, one count of stealing a motor vehicle, and one count of resisting arrest. During the arrest appellant was shot by the police and required hospitalization. While confined at the hospital, appellant made a video-taped confession. Charles Hyler was appointed by the court to represent appellant on May 1, 1973. During the preliminary hearing the court viewed the video-tape and appellant was positively identified by a witness to the robbery. After the charges against him were reduced to two counts of second degree murder, appellant entered pleas of guilty and was sentenced to two concurrent terms of forty (40) years imprisonment. Appellant filed his motions with the circuit court on August 5, 1974, seeking to vacate the judgments. The court appointed counsel to represent appellant; held a hearing on the motions, and denied both of them.
